probably not seeing how the riding season is winding down in areas
north,  many of you have looked at this soooooooooo

before I start getting accused for telling everyone they don't know
crap about their mc ins, well all I will say is, many do not, and this
may just help one person one day, for the rest of the know it alls
well don't waste your time reading any further.

for the rest that might want a reminder or have never seen this take a
look at www.bikershut.net/nc_ins.htm, it is pretty much been covered
by PI MC lawyers in three states now to be good information.

at the least check in with a PI lawyer and see if your states laws
have changed, or you health ins coverage's have changed to omit MC
accidents (or other "dangerous" activities) the AMA is working to try
and stop the health ins carriers from doing this as far as I know.

HIPAA UPDATE

The Motorcycle Riders Foundation is pleased to report that HR 1076 will
be
marked up by the US House Committee on Energy and Commerce tomorrow
September 17th at 10 AM. The legislation to close the loophole that
allows
insurance companies to refuse payment for an injury that happens on a
motorcycle will be marked up in open session along with ten other bills
in
the Rayburn House Office Building.

HR 1076 is expected to pass favorably, however anything can happen in a
markup. In order to ensure swift clean passage we are asking you to
contact your Member of Congress IF they are a Member of the Energy and
Commerce Committee. That list follows this email.

This Committee action is the most important legislative activity since
the
full Senate passed a version of this bill in late winter, 2005.  We thank
Chairman Dingell, HR 1076 sponsors, co sponsors and their staff for their
attention to this very important matter.

The MRF will keep you informed on any future developments of this
legislation.

Also, please write to your senators to support the Senate version of the
bill.  There is a link at the bottom of this quote that allows you to email
your representitives.

From the Texas Motorcycle Rights Association, and the AMA:

<quote>

Fellow Riders,

The US Congress is now in session again.
We need to pass Senate Bill 616.
This bill would end health care discrimination for individuals participating
in
legal transportation and recreational activities like motorcycling,
snowmobiling, skiing, horseback riding, ATV riding, etc. Please call, write,
or
email your two US Senators and respectfully ask them to support S. 616,
"The HIPAA Recreational Injury Technical Correction Act" and tell
them why they should.  Please pass this message on to everybody else that
agrees with us so they can write similar emails, letters, or phone calls.

And this today...

The United States House of Representatives Committee on Energy and
Commerce today passed legislation that would make it illegal for insuranc=
e
providers to exploit what is known as the "source of injury exclusion"
loophole, the Motorcycle Riders Foundation (MRF) reports.

Under current law, insurance providers can refuse to pay for treatment of=

an injury based solely on the source of the injury, with no prior notice
of denial of benefits for that source of injury simply by pointing to the=

“source of injury” law that exists today.

Some sources of injury that can be used as a reason by insurance provider=
s
to refuse payment of medical bills are motorcycling, snow skiing, ATVs an=
d
horse back riding.

This new legislation, HR 6809, known as the Health Insurance Source of
Injury Clarification Act, does not entirely replace HR 1076. Where HR 107=
6
makes it illegal to deny benefits for any injury that occurs during legal=

transportation or recreation, this bill does allow for limitations of
payment if the provider follows some rules.

According to HR 6809, if an insurance provider wants to be able to put
limitations on payment for an injury from a specific source, they must
meet the following requirements.

+ "Make such limitations and restrictions explicit and clear;"
+ "If part of a group plan, must be disclosed to plan sponsor in
advance of the point of sale of plan;"
+ "The plan sponsor and issuer of health insurance coverage provide a=

description that is easily understandable to the participant prior to
enrollment."

To summarize the legalese, your health insurance provider can limit
payment for an injury sustained on a motorcycle so long as it is spelled
out to you in simple terms, well in advance of you joining the plan.

"HR 6908 is not a touchdown, but it's moving the ball a good way down the=

field”, said Jeff Hennie, Vice President of Government Relations for th=
e
Motorcycle Riders Foundation. "Considering the fact that the Federal
government just bailed out one of the giants in the insurance world to th=
e
tune of $85 billion, I don't think Congress is in any mood to mandate
insurance to cover anything, even transportation."
