Please sign this petition (not mine, just spreading the word) against an
extremely harsh and unfair bill that may become law in NYC . I am personally
against deafeningly loud motorcycles but this bill is the wrong way to go about
it.

Just on a skim, the proposed legislation includes provisions for:
a)Parking of violating machines being a violation (easing enforcement as it
isn't required to operate it).
b)Stiff fines.
c)Impounding of the bike.
d)Forfeiture of the bike if not claimed in a timely way or for repeat
offenders.
Gotta agree with you. (a) and (b) should be enough ... (c) and (d) are just
plain going too far. You'd run into the case of the guy who parks a
non-offending bike on the street and it gets misidentified, then
coincidentally he has business in Europe for several weeks and by the time
he gets back his $20,000 baby is not property of the State. The potential
for mishap and abuse is substantial.
(c) and (d) are out of this world. (a) and (b) should be good enough.
If they do (c), there should be no forfeiture provision. Furthermore, if
they do (c), there should be a provision that any motorcycle owner who has
his bike taken away by mistake twice during his entire life is lifetime
exempt from further enforcement action. I could see swarms of ill-trained
parking enforcement officers making lots of mistakes ... anyone who has to
fetch their bike from impound twice because it was misidentified should IMHO
be lifetime exempt.

Yes, it goes way over the top, and FWIW, I have OEM exhaust with the EPA stamp.

So what do you think is the RIGHT way to go about it ??
All the previous efforts at enforcement have failed, largely because a small
but ever increasing segment of the riding population has ignored the
existing laws and flaunted their defiance.
This kind of enforcement effort is totally predictable. It WILL be
happening in more and more places........as long as the number of bikes with
ILLEGAL pipes continues to increase.
Loud pipes risk rights.

I am not the author of the comment you responded to.
My only concern with this style of enforcement is that mistakes by the
authorities could be very costly to a motorcycle owner. Whenever you can
impound then dispose of a parked vehicle without observing it actually
making noise in the presence of the owner ... bad idea.
Ticketing in absentia ... fine. Impounding a motorcycle because you believe
it will make noise if the owner starts it ... bad idea.
